STATUS OF TERMS

 

• These terms constitute a legal document ("the Agreement"), which sets out the rights and obligations of you as a purchaser ("you"), and those of EDC Direct ("Electrical-shopping.com ", "we" or "us"), in relation to the services and products offered by us through this site or any of the other sites owned by us. By registering for or using Electrical-shopping.com services, you agree to the terms of this Agreement, and you re-affirm that agreement every time you use any of our services.
• You agree to:
• 1. provide true, accurate, current and complete information about you as prompted by our registration form (such information being the "Registration Data"); and
• 2. maintain and promptly update the Registration Data to keep it true, accurate, current and complete.
• If you provide any information that is untrue, inaccurate, not current or incomplete, or Electrical-shopping.com has reasonable grounds to suspect that such information is untrue, inaccurate, not current or incomplete, Electrical-shopping.com has the right to suspend or terminate your account, cease supply and refuse you any and all current or future use of the Electrical-shopping.com site (or any portion of it).

 

PLACE OF PERFORMANCE AND APPLICABLE LAW:

 

• EDC Direct is a company registered in England (VAT number 204665771.). Unless otherwise specified, the materials on this site are directed solely at those who access this site from England. Electrical-shopping.com makes no representation that any product referred to in the materials on this site is appropriate for use, or available, in other locations. Those who choose to access this site from other locations are responsible for compliance with local laws if and to the extent local laws are applicable. English law shall govern this Agreement.
• You and we each submit to the exclusive jurisdiction of the English courts in relation to disputes arising out of this Agreement.

 

GENERAL:

 

• The owner of this web site is EDC Direct Ltd whose address is Isha House, 8 Wrotham Road, Gravesend, DA11 0PA. Registration number 3497866.
• Your contract for purchases made through the Site is with Electrical-shopping.com, and you undertake that any and all goods ordered by you are for your own private and domestic use only.
• You must be eighteen years old to use this site. If you are under eighteen, you may only use the site in conjunction with, and under the supervision of, a parent or guardian. If you do not qualify, please do not use the site.
• While we try and ensure that all prices on our website are accurate, errors may occur. If we discover an error in the price of goods you have ordered we will inform you as soon as possible and give you the option of reconfirming your order at the correct price or cancelling it. If we are unable to contact you we will treat the order as cancelled. If we cancel and you have already paid for the goods, you will receive a full refund.
• If the product not in stock, and we are otherwise unable to obtain the product we will offer a full refund of any charges already made for the product.
• No contract for the sale of any product will subsist between you and Electrical-shopping.com until Electrical-shopping.com dispatches the product(s) ordered. We will confirm that the product(s) have been dispatched by a confirmation email. This confirmation e-mail amounts to an acceptance by Electrical-shopping.com of your offer to buy goods from Electrical-shopping.com or a third party supplier that is engaged on your behalf by Electrical-shopping.com (whether or not you receive that e-mail).
• You agree that e-mail can be used as a long-distance means of communication.
• This confirmatory e-mail will contain all relevant statutory information concerning your contract.
• The confirmatory e-mail will also contain a link to these terms and conditions, and may be amended from time to time.
• You must check that the details on this confirmatory e-mail are correct as soon as possible and you should print out and keep a copy of it.
• We will not collect any Credit/Debit card details through this website. The payment process including the collection and storage of Credit/Debit Card details is handled by World Pay, and we are not responsible for their actions.
• You undertake that all details you provide to Electrical-shopping.com for the purpose of ordering or purchasing goods or services are correct, that the credit or debit card you are using is your own and that there are sufficient funds to cover the cost of the goods or services ordered.
• If you register an account with Electrical-shopping.com than you are responsible for all actions taken under that username and password and shall only use the Site under your own username and password. You must make every effort to keep your password safe and should not disclose it to anyone. If it is compromised, you must change it. You may not transfer or sell your username to anyone, nor permit, either directly or indirectly, anyone to use your username or password.
• If there are any changes to the details supplied by you it is your responsibility to inform Electrical-shopping.com as soon as possible.
• Electrical-shopping.com reserves the right to make a 15% restocking charge for any goods which are not returned in mint condition or to refuse to accept such goods, at its sole discretion. Electrical-shopping.com also reserves the right to make a charge for collecting goods from your premises in circumstances where they are not defective but you have cancelled your order. Your statutory rights are not affected.

 

PLACING AND PROCESSING AN ORDER

 

• A notice will be displayed on your web browser before you submit an order with Electrical-shopping.com. This contains important information such as the description, price and delivery charges of the good or services ordered. Electrical-shopping.com suggests that you print off a hard copy of the notice or save a copy to your hard drive for your own records.
• Goods supplied to you by Electrical-shopping.com will correspond with their prices and description (subject to E & OE). If at any time this is not the case Electrical-shopping.com will give you the right to reject the goods within 7 days for a full refund.
• In the unlikely event that an incorrect price is shown on our website. Electrical-shopping.com reserves the right to abstain from fulfilling the order at that price. You will of course be notified, and at which point you will be informed of the correct price, and given the choice to proceed with the order.
• Our standard Returns Policy applies to all purchases from Electrical-shopping.com.
• Please be aware that the process, costs to us and logistics behind supplying products in-store differ greatly from those behind supplying products online. The prices displayed on this website apply to online sale only, we reserve the right to charge a different price in-store than we display on this website if we in our sole discression deem it necessary.

 

COLLECTION, CANCELLATION & RETURNS POLICY

 

 

Returns Collection:

 

• Please note that there is no fixed charge for collections as this is very much dependant on size, distance and type of the goods. Please call client support on 01474 35 3000 for a collection quote. Alternatively you may choose your own form of insured return at your own cost.
• Subject to the right of Consumers to return goods for refund under The Supply of Goods and Services Act and Distance Selling Regulations, Electrical-shopping.com does not sell products on a trial basis. Customers are strongly advised to check suitability and specifications of products before ordering.

 

Cancellation:

 

• You have the right to cancel your purchase at any time either before or up to 7 working days starting the day after delivery by e-mailing us at stating your name, a description of the goods or services concerned and the order number of the cancelled order
• The product you receive may not as exactly as it’s shown in the picture. You have the right to return such products within 14 days of receiving.
• Your product must be complete and in 'as new' condition (e.g. if you have opened the box to examine the product you must have done so without damaging or marking the product or packaging).
• Please note that if you cancel an order, which has been processed and dispatched, you will be refunded the value of the goods less the return costs. However if you have received the goods and still wish to cancel or return, then please see collections. The 7-day period does not start until the day after receipt of the goods by the customer. Goods are refunded within 30 days.
• It must not have been used or installed. It should be returned with the original box, packing and accessories you received with it.
• Software and memory cards can only be accepted if still sealed. This policy is to avoid any potential breach of the Copyright, Designs and Patents Act (CDPA) 1988. All opened software is exempt from return under the terms of the distance Selling Regulations (SI2334/2000). Software that arrives damaged or is physically faulty may be returned under our normal returns policy.
• A proof of purchase must be supplied.
• You must return any free gifts which came with the product.
• You must return any other products that came at a discount with the product, such as those selected in the left box of the product's page on this site
• We will not refund any items that have been specially ordered to your individual specification or personalised.
• Any vouchers (physical or virtual) that you have received or are due to receive as part of a cancelled order will be voided. If those vouchers have already been redeemed as part of another order then you will be charged the value of the vouchers.
• Goods returned outside the 7 days cancellation period (but within 28 days of receipt) that can not be re-sold as new will only be refunded to their mail order return value and a credit note may be issued.
• Where we have made a charge for postage, this will be deducted from your refund if outside of the 7 day cooling off period.
• Electrical-shopping.com will not accept cancellation of any orders where the item(s) purchased are not normally held in stock but have been specifically ordered at the request of the customer.

 

Cannot Cancel your purchase if:

• the seal has been broken on any memory cards, or software; or
• the goods were a special order to your specification; or
• 28 days has elapsed following receipt of the goods
• Until such time as you return the goods to us you must take reasonable care of the item(s) and not use them. Any use of the delivered goods beyond that necessary to inspect the goods upon delivery will invalidate your right to cancel the contract.

 

Refunds:

 

• Upon return of the goods, a full inspection will be carried out by our Returns department, who will check if all the correct products have been returned with the correct accessories and their condition. Any missing accessories will be deducted from the refund or charged for. An Indication of the charges for missing accessories:
• 1. Chargers /Adaptors: £50 ex Vat
• 2. Headphones: £30 ex Vat
• 3. Instruction Manual: £20 ex Vat
• 4. Lead: £30 ex Vat
• 5. Media Card £50 ex Vat
• 6. Memory stick £50 ex Vat
• 7. Remote Control £65 ex Vat
• 8. Product Stands missing or incomplete will be charged at the full replacement cost of the stand plus 25% handling fees.
• 9. Miscellaneous £15 ex Vat.

 

Authorizing the Returns:

 

• You MUST prior to returning any goods received, contact our Customer Services by e-mail at stating your name, a description of the goods or services concerned and the order number of the cancelled order. Failure to do so will result in a delay in processing your refund or the product being returned to you. All authorised returns must be returned to EDC Direct LTD, Unit 32, Acorn Industrial Estate, Crayford, DA1 4AL.

 

Faulty or incorrectly described goods:

Product Guarantees:

 

• The manufacturer guarantees all purchases for a period of 12 months, unless stated, from date of invoice. The guarantee excludes faults caused by accident, neglect or misuse by the customer. In addition, routine maintenance (cleaning of dirty audio/video heads etc), consumables (styli, plug fuses, cables, batteries, etc), cosmetic damage and tuning of channels are not covered. The full cost of service will be charged if no fault is found with your product. You do have the right to have an independent expert assess your goods if you feel this is necessary.
• The customer is responsible for returning any goods at their own expense. Damaged or faulty goods on arrival are excluded from this. If your product should fail within this period, our customer services department will arrange for repair by the manufacturer's authorised service agents.

 

Extended Warranty:

 

• Electrical-shopping.com offer good value Extended warranties from Domestic & General for a total of up to 5 years protection. The price range for these warranties can be found on our product pages and an added benefit is the inclusion of damage caused by accidents. Domestic & General are specialists in extended warranties and have over 6 million plan holders. You are advised to read Domestic & General's own terms and conditions that can be found on their own website

 

FREEVIEW:

 

• It is your responsibility to check that a digital TV or product featuring Freeview that you wish to purchase is compatible in your area. For more information check www.freeview.co.uk.

 

CONTENT:

 

• Electrical-shopping.com shall not be liable to any person for any loss or damage, which may arise from the use of any of the information contained in any of the materials on this site. Electrical-shopping will only be liable for consequential losses within the contemplation of the parties.
• Certain links in this site (typically a banner advert or icon) will lead to sites, which are not under the control of Electrical-shopping.com. When you activate any of these you will leave the Electrical-shopping.com site and Electrical-shopping.com has no control over and will accept no responsibility or liability for the material on any site, which is not under the control of Electrical-shopping.com.

 

LIMITATION OF LIABILITIES:

 

• This section applies only to the extent permitted by law. For the avoidance of doubt, Electrical-shopping.com do not exclude or limit any liability for (a) personal injury (including sickness and death) where such injury results from Electrical-shopping.com's negligence or willful default, or that of Electrical-shopping.com's employees, agents or subcontractors or (b) fraudulent misrepresentation.
• Electrical-shopping.com does not accept liability (except as set out below) for any errors and omissions and reserve the right to change information, prices, specifications and descriptions of listed goods, products and services.
• If an error is discovered in the price of the goods that you have ordered, we will inform you as soon as possible. We shall be under no obligation to fulfill an order for a product which was advertised at an incorrect price;
• Electrical-shopping.com will do its best to correct errors and omissions as quickly as practicable after being notified of them.
• To the fullest extent permitted by law, Electrical-shopping.com is providing this site and its contents on an ‘as is’ basis and makes no (and expressly disclaims all) representations or warranties of any kind, express or implied, with respect to this site or the information, content, materials or products included in this site including, without limitation, warranties of merchantability and fitness for a particular purpose. In addition, Electrical-shopping.com does not represent or warrant that the information accessible via this site is accurate, complete or current.
• In the unlikely event that you receive goods which were not what you ordered or which are damaged or defective, or are of a different quantity to that stated on your order form, Electrical-shopping.com shall, at its own option, make good any shortage or non-delivery, replace or repair any damaged or defective goods, or refund to you the amount you paid for the goods in question PROVIDED THAT you notify Electrical-shopping.com of the problem in writing at the address stated in the confirmation e-mail within 10 working days of delivery of the goods. NOTHING IN THIS CLAUSE AFFECTS YOUR STATUTORY RIGHTS.
• Electrical-shopping.com will only be liable under these Terms for losses which are a reasonably foreseeable consequence of the relevant breach of contract.
• The products sold on the Site are provided for private domestic and consumer use only. Accordingly, Electrical-shopping.com do not accept liability for any indirect loss, consequential loss, loss of data, loss of income or profit, loss of damage to property and/or loss from claims of third parties arising out of the use of the Site or for any products or services purchased from Electrical-shopping.com.

 

DELIVERY/TITLE/RISKS:

 

• The period stated within which you will receive your order is approximate. Goods will be sent to the address given by you in your order and stated in the Order Confirmation. Please note that your goods may be sent to you in installments. You may cancel your entire order with us if subsequent installments forming part of your order are not delivered by us.
• For Christmas Deliveries, we recommend that you order by the 18th December. We will endeavor to dispatch all ‘in stock’ orders within 24 hours, however we cannot guarantee delivery on or before the 24th December as the post may be delayed in your area
• Electrical-shopping.com will not accept liability for goods lost in transit unless notified within 5 days from the expected delivery date.
• It will be your responsibility to inform us of any damages within 7 days of receipt of goods, as we need to inform the couriers used. Couriers will not accept claims made after 7 days. If goods returned under this clause are found to be perfect and in full working order they will be returned to you and an administration fee will be charged along with the cost of carriage to your credit card account. This does not affect your statutory rights as a consumer.
• If you are sent incorrect goods you most notify EDC Direct within 7 days, if you want to replace.

 

MISCELLANEOUS:

 

• We shall have no liability (including liability for negligence) for the acts or omissions of telecommunications service providers or for failures of, or faults in their networks and equipment.
• No waiver by us of any breach of these Terms shall be considered as a waiver of any subsequent breach of the same or any other provision.
• You may not permit or perform deep linking to the Site or the creation of derivative works thereof from any other website under your management or control.
• In these Terms, ‘Intellectual Property Rights’ means patents, database rights, copyright, design rights (whether registered or unregistered), trade marks (whether registered or unregistered) and other similar rights, together with the right to apply for the protection of any such rights. All Intellectual Property Rights in the Site shall be owned by us absolutely.
• Subject to the license granted to you to use the Site, Electrical-shopping.com reserves all rights, title and interest in its Intellectual Property Rights in the Site. Any goodwill accruing from use of Electrical-shopping.com and its affiliates’ trade marks, trade and business names and service marks under this Agreement will vest in Electrical-shopping.com and its affiliates, as appropriate.
• It is a crime to use a false name or a known invalid credit card to order. Anyone caught willfully entering an erroneous or fictitious order will be prosecuted to the fullest extent of the law. Electrical-shopping.com tracks the electronic ‘fingerprints’ of every order placed on Electrical-shopping.com to enable us and all legitimate crime prevention and prosecution authorities to trace individual users engaging in criminal activities on our website.
• We reserve the right to terminate this Agreement and to suspend or terminate your access to the Site immediately and without notice to you if:
• you fail to make any payment to us when due;
• you breach the terms of this Agreement (repeatedly or otherwise);
• when requested by us to do so, you fail to provide us within a reasonable time with sufficient information to enable us to determine the accuracy and validity of any information supplied by you, or your identity;
• we suspect you have engaged, or about to engage, or have in any way been involved, in fraudulent or illegal activity on the Site.
• Any other reasons that we are legally permitted to use.
• Electrical-shopping.com may amend these Terms from time to time, and place the new version on the Site. When Electrical-shopping.com do so, it will mention the fact on our home page (www.electical-shopping.com). For users purchasing goods or registering on the Site for the first time, all purchases from the date that the amended terms are placed on our website onwards will be governed by those new terms Otherwise, such changes will be effective against existing users thirty days following posting of the amended version on the Site. Your continued use of the Site following Electrical-shopping.com’s posting of any changes will constitute your acceptance of such changes. If you do not agree to any changes to these Terms, then your only remedy is to cease using the Site.
• These Terms supersede any and all other conditions, understandings, commitments, agreements or representations (except fraudulent misrepresentations) relating to your purchase, whether oral or in writing, and contain the entire agreement between Electrical-shopping.com and you relating to your purchase. Electrical-shopping.com advises that you print off and keep safe a copy of these terms and conditions once your order has been accepted by Electrical-shopping.com. We will store a copy of the contract entered into by you with Electrical-shopping.com. You are advised to read (and are responsible for reading) fully all information on this website.
• If any provision of these Terms shall be held by any competent authority to be invalid or unenforceable in whole or in part, the validity of the remaining parts of these Terms and the remainder of the affected provision shall be unaffected.

 

MATTERS BEYOND OUR REASONABLE CONTROL:

 

• Electrical-shopping.com shall not be held liable for any breach of this Agreement caused by circumstances out of its control including, but not limited to, Acts of God, fire, lightening, flood, or extremely severe weather, explosion, war, disorder, industrial disputes (whether or not involving our employees), acts or omissions of Internet services providers or acts of local or central Government or other authorities.

NEW W.E.E.E Regulations

 

Under new regulations introduced in July 2007, we as retailers of electronics goods have to offer takeback on your old electronic equipment. If the old products are returned back to us there shall be no cost involved to you.

If you wish us to collect goods from you there will be charges applicable at the following prices:

• Washing Machines/Dryers/Dishwashers - £80.00
• Cookers - £100.00
• Fridge Freezers - £80.00
• American Fridge Freezers - £160.00
• Televisions 32" and under - £40.00
• Television 37" and above - £60.00
• Other - Varies, please call and ask
